1.1) These terms and why you should read them: Please read these terms carefully before using our online platform and before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other relevant information. 1.2) Who we are: This online platform is owned and operated by Littles International for Wholesale and Retail Trading Co. sharq Jibla, Kuwait and/or its associates, related parties, successors, and assigns (collectively from now on referred to as ("we" or "us" or "Littles"). Our business license No. 2021/443774 referred to as "Littles." This online application will be referred to as "Application."  Littles App assists parents in every stage, from pregnancy to child development. Our inspiration is to build the best online store application and your order is prepared and delivered by us. By downloading or otherwise accessing the application, you now agree to be bound by our general Terms and Conditions. There may be additional features on the platform, those special features may have its own Terms and Conditions, and those other Terms and Conditions would apply in the context of the use of Application along with these Terms and Conditions.1.3) How to contact us:  604405091.4 How we may contact you: If we have to contact you, we will do so by telephone or by writing to you at the email address you provided to us in your order/account. 

2- Application of our terms and Conditions

Our Terms and conditions apply to the below:

• Any person accessing and downloading Littles Application.
• Any person registering through the application by providing the information below:Name, email address, delivery address, Mobile number/ Contact number.
• As part of the registering process, you will create an account or log in through social media. It is your responsibility to provide us with accurate information.
• If you suspect that your personal information was disclosed to another party, contact us immediately. Kindly note that we do not contact our users to confirm their username and password.
• How we may use your personal information.  We will only use your personal information as set out in our [LINK TO PRIVACY POLICY].
• By accepting our Terms and Conditions you become a user, we may stop providing you with ourservices if you don't comply with our Terms and Conditions. 3- Eligibility for registration
• You are 18 years of age or older
• Your access to our application doesn't violate the law
• You will provide accurate information and up to date
• You must provide us with a precise address and phone number to guarantee an accurate delivery
process.          

4- Placing an order through our application
 

4.1) How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. Please ensure that you provide us with the correct address and number to guarantee an accurate delivery process.4.2) If we cannot accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified. 4.3) Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us
about your order.4.4) We only sell to Kuwait. Our website is solely for the promotion of our products in Kuwait. Unfortunately, we currently do not [accept orders from OR deliver to] addresses outside of Kuwait 

5- Delivery of products 5.1) Littles is an online gifting application. You can shop directly from our application, and we will deliver the products with the best service we can provide.5.2) Delivery costs. The costs of delivery will be as displayed to you on our website.5.3) When we will provide the products. During the order process, we will let you know when we will deliver the products to you.   5.4) We are not responsible for delays outside our control. If an event outside our control delays our supply of the products, then we will contact you as soon as possible to let you know, and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to cancel the order and receive a refund for any products you have paid for but not received. 5.5) If you are not at home when the product is delivered. If no one is available at your address to take delivery and the products cannot be left in a safe place, we will leave you a note informing you of how to rearrange delivery. 5.6) When you become responsible for the goods. A product will be your responsibility from the time we deliver the product to the address you gave us.5.7) When you own goods. You own a product once we have received payment in full.5.8) Your rights if we suspend the supply of products. We will contact you in advance to tell you we will be suspending the supply of the product unless the problem is urgent or an emergency. If we have to suspend the product for a while, we will adjust the price so that you do not pay for products while they are suspended. You may contact us to cancel the order for a product if we suspend it, or tell you we are going to suspend it, in each case for a period and we will refund any sums you have paid in advance for the product in respect of the period after you end the contract. 

6- Your rights to cancel the order: 6.1) You can always cancel the order with us.  Your rights when you contract cancel the order will depend on what you have bought, whether there is anything wrong with it, how we are performing, and when you decide to end the contract: 

• If what you have bought is faulty or misdescribed, you may have a legal right to end the contract (or to get the product repaired or replaced or to get some or all of your money back).   

7- Exchange / Return policy 
• According to Article 10 of Kuwait Law No. 39/2014 On Customer Protection and Kuwait Ministerial Decision No. 27/2015 On the issuance of the Implementing Regulation of Kuwait Law No. 39 /2014 On Consumer Protection: All Customers have the right to return, exchange, or receive a refund for items purchased from Littles within 14 days from purchase under the following conditions:
• The consumer shall not have used the product in any way whatsoever.
• The condition of the commodity remains the same as it was at the time of purchase.
• Returned items must be in their original packaging with all its original content.

• It should also be in the same brand box you received.
• Returned items must be in good condition and not used along with the original tag.
• Products with a nature that does not permit or allow its return or exchange, such as Personal care and hygiene products are not eligible for returns or exchanges. For example (shaving equipment, opened perfumes, etc.), those examples are not limited. 
•  Highly perishable consumer goods are not eligible for returns or exchanges unless it was proved at the time of purchase that they are corrupt or unfit for human consumption.
• If the reason for replacement is related to sizes, the purchaser shall use the right of replacement or return within a period not exceeding five days. In case the alternative size is not available, the consumer shall have the right to use the option of return and recovery of the value of the good, provided that the choice of size is stated in the purchase invoice.
• Your obligation to return rejected products. If you wish to exercise your legal rights to reject products, you must allow us to collect them from you.
• Note: Unfortunately, we have a no-return policy on some of our products. We recommend our customers to read the product description carefully before purchasing your desired gift.    

8-    Refunds
• All customers have the right to receive their refund against returned items in the same form of payment made at the time of the original purchase
• All customers have the right to receive your refund in full (excluding delivery costs). We will not deduct any kind of transaction fees, such as Visa/MasterCard/Knet fees or processing fees, from your refund amount.
• We may reduce your refund of the price to reflect any reduction in the value of the goods if this has been caused by your handling them in a way that would not be permitted in a shop.
• All customers have the right to receive the refund within 14 days of your original request. 

9- Price and Payment
• The price of any Products will be listed on our application, Prices are subject to change at any time. Still, the changes will not affect orders in respect of which you have been presented with the Confirmation Email, message. Whereby we will notify you as soon as we can about the pricing issue. 
• What happens if we got the price wrong? It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will frequently check prices before accepting your order so that, where the product\'s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product\'s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. [If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognized by you as a mispricing, we may cancel the order, and refund you any sums you have paid and require the return of any goods provided to you.]

• Payment for all Products can be made by cash on delivery or credit or debit card through our service. Once your order has been confirmed, your credit or debit card will have been authorized and the amount marked for payment. Payment is made directly to Littles
• You must pay for the products before we dispatch them. 
• Your refund will be made within 14 days from the day on which we receive the product back from you.

10- Intellectual propertyIntellectual property rights only cover your personal information or information uploaded on our application. Using our application doesn't grant you intellectual property.

11- commentsProtecting other User\'s rights and other reasonable restrictions
• You will not post any content or take any action on our application that breaks the terms of the law on the rights of the other User or violates any law.
• We reserve the right to remove any content or information if we believe that it violates these terms and conditions.
• Because of the use of any copyright and trademark or you use any logo and trademark, which is deceptively similar to the already existing trademarks without our prior written consent, we will disable your account when appropriate.you shall not upload, post, email, transmit or otherwise make available through or in connection with the application any User Content that may be   ( illegal, harmful, threatening, abusive, harassing, tortuous, defamatory, pornographic, obscene, libelous, invasive of another\'s privacy, hateful, or racially, ethnically or otherwise objectionable; infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, comprises unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas that are designated for such purpose; contains software viruses, trojan horse, worm, time bomb or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment) 
• How we may use your personal information.

12- Links to other websites Our service may contain links to third- party web sites or services that are not owned or controlled by LittlesLittles must control nor responsibility for the privacy policy, function, or practices of any other third-party service. Littles shall not be liable, directly, or indirectly for any loss caused or claimed to be lost by or in connection with the use of other websites.We advise you to read our terms and conditions and privacy policy.    

13- Exclusion of liabilities
• You expressly understand and agree that Littles, its subsidiaries or affiliates shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:  
• the accessing of, or the inability to access, the application, the use of, or the inability to use of the application, all implied warranties, 

Terms and Conditions relating to the application;

• unauthorized access to or alteration of any of your transmissions or data, including any User Content; and 
• Any warranty, terms, or conditions as to accuracy, completeness, quality of the application.   

14- Limitation of liability Littles company, nor its partners, employees, partners, suppliers, agents, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:  
• unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
• Any content obtained from the service and an unauthorized access use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. 15- Site policy and modificationsPlease review our other policies, such as our privacy policy, available on the Littles application. These policies also govern your use of Littles Services. We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.16- CopyrightAll copyright in all material available through the application are owned by Littles or its proprietary holders, particularly the photographs of the products and you are required to abide by all copyright notices contained on the application. The User is under obligation to comply with the copyright notices and would be liable for any violation, and Littles, as a result of this, disclaims any liability in this regard. 

17- Force Majeure  Littles shall have no liability or be deemed to be in breach of the Agreement for any delays or failures in performance of the Agreement, which result from circumstances beyond the reasonable control of the Party affected. 

18- Third-party beneficiaryThe registered User may not assign the registration or account to a third party, as stated in the terms and conditions. 

19- ViolationAny violation, breach, transgression, and infringement to the Terms and Conditions should be reported to by the User to email gm@Littles-kw.com

20-TerminationWe may terminate or suspend your account without notifying you or liability for any reason whatsoever, and if you breach the terms and condition without limitation, upon termination your right to use our service will be ceased effective immediately, if you want to terminate your account, you may discontinue using our service.   

21- DisclaimerYour use
of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.Littles its subsidiaries, affiliates, and its licensors do not warrant that:
• the service will function uninterrupted, secure, or available at any time or location.
• Any errors or defects will be corrected.
• The service is free of viruses or other harmful components; or

• the results of using the service will meet your requirements.  

22- Governing lawThe Terms and Conditions will be legally binding. Any dispute or claim arising out in connection with the Terms and
Conditions will be addressed according to the laws of the State of Kuwait.
